Terms of Service

Effective Date: May 2025

Welcome to California Dental Arts. By accessing or using our services, you (“Client” or “Doctor”) agree to comply with and be bound by the following Terms of Service (“Terms”).

Please read these Terms carefully. If you do not agree with any part of these Terms, you should refrain from using our services.

1. Acceptance of Terms

By using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

2. Services Provided

California Dental Arts (“the Company”) provides dental restoration manufacturing services, including but not limited to crowns, bridges, implants, dentures, and other dental prosthetics (“Services”). These Services are intended exclusively for licensed dental professionals.

3. Orders

  • All orders must be submitted by licensed dental professionals.

  • A valid credit card must be on file with the Company before placing an order.

4. Cancellations and Returns

  • The Company reserves the right to charge for canceled orders based on the amount of work completed at the time of cancellation.

  • Due to the custom nature of our products, returns are not accepted. In the event of a product defect or issue with an order, the Client must notify the Company within 30 days of delivery to request resolution.

5. Pricing

  • Product and service pricing is subject to change without prior notice.

  • Clients may request current pricing or a formal quote prior to placing an order.

  • Orders exceeding seven units will incur a reconstruction fee, excluding AOX cases.

  • Submitting both analog and digital impressions for the same case without proper notation on both prescriptions (RXs) and prior communication with the Company will result in duplicate charges.

6. Billing

  • Orders are invoiced upon completion. Try-ins will be invoiced a percentage of the total cost upon delivery, depending on the type of case.

  • Payment terms are net 30 days from the invoice date unless otherwise agreed in writing.

  • Credit card payments are subject to a processing fee as defined by the Company.

  • Accepted payment methods include ACH transfer, check, and credit card (subject to applicable fees). Payment instructions will be provided on the invoice.

  • Accounts that become past due will require payment via cash on delivery (COD).

  • Fees for diagnostic and aesthetic wax-ups will be invoiced once the work has been completed, even if the patient or doctor decides not to proceed with the case thereafter.

  • Fees for in-office visits and scanning appointments will be billed if our team arrives at your office, regardless of the case outcome. This includes scenarios where the patient is not ready, the implants are not stable enough for scanning, or the case is later canceled by the doctor.

  • Any loaned tools included with a case will be charged at the time of invoicing. A refund will be issued upon return of the tool. If the tool is returned more than 30 days after the invoice date, the Client will receive an account credit rather than a refund.

7. Delivery and Shipping

  • The Company aims to meet delivery timelines but is not liable for delays due to circumstances beyond its control (e.g., weather, labor disputes, carrier shipping delays).

  • Standard shipping is included; however, expedited deliveries will incur a rush fee.

8. Diagnostic Wax-Up Requirement

To ensure predictable outcomes and optimal aesthetics, California Dental Arts requires a diagnostic wax-up for the following case types:

  • Anterior restorations (teeth #6–11 and #22–27)

  • Full-arch restorations

  • Large-span bridges (4+ units)

  • Cases involving changes to vertical dimension of occlusion (VDO)

  • Bite reconstructions and occlusal rehabilitations

  • Complex esthetic or functional cases

This requirement is not limited to the examples above. The prescribing doctor must approve the wax-up before final restorative work begins. If a wax-up is not provided, California Dental Arts may fabricate one at the Client’s request and expense.

If the prescribing doctor waives this requirement in writing, the Company will proceed using its best professional judgment. In such cases, the Client assumes full responsibility for the final outcome—including esthetics, fit, occlusion, and function—and remains liable for all related charges.

Please note: This policy does not apply to Advanced Prosthetics cases, as a diagnostic wax-up is always included in those cases.

9. Intellectual Property

All content, trademarks, and intellectual property related to the Company’s website and Services are owned by or licensed to California Dental Arts. Unauthorized use is strictly prohibited.

10. Limitation of Liability

To the maximum extent permitted by law, California Dental Arts is not liable for any indirect, incidental, special, or consequential damages related to the use of its Services.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.

12. Changes to Terms

The Company may update these Terms at any time. Changes take effect immediately upon being posted on our website. Continued use of our Services constitutes acceptance of the updated Terms.
